By accessing or using BuzzInsect ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users including Creators, Brands, and Administrators.
2. Description of Service
BuzzInsect is an influencer marketing marketplace that connects content creators ("Creators") with brands and businesses ("Brands") for collaboration opportunities. We provide tools for discovery, communication, campaign management, and payments.
3. Eligibility
You must be at least 18 years of age to use this Platform. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.
4. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- You may not create multiple accounts or impersonate any other person or entity.
5. Creator Terms
As a Creator on our platform, you agree to:
- Provide accurate and truthful information about your social media metrics, follower counts, and engagement rates.
- Submit to our verification process before your profile is listed publicly.
- Not inflate or misrepresent follower counts or engagement metrics through artificial means (bots, purchased followers, etc.).
- Fulfill any collaboration agreements made with Brands through the platform.
- Disclose paid partnerships as required by applicable advertising standards and regulations (e.g., ASCI guidelines in India, FTC in the US).
- Not share confidential campaign information without the Brand's consent.
6. Brand Terms
As a Brand on our platform, you agree to:
- Provide accurate company and campaign information.
- Communicate respectfully and professionally with Creators.
- Honor any payment agreements made with Creators for completed work.
- Not use creator contact information obtained through the platform for purposes outside of legitimate collaboration.
- Ensure your campaigns comply with applicable laws, regulations, and advertising standards.
- Not spam or send unsolicited messages to Creators.
7. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Post false, misleading, or fraudulent information.
- Harass, threaten, or intimidate other users.
- Attempt to gain unauthorized access to any part of the Platform or other users' accounts.
- Use automated tools, bots, or scrapers to access the Platform without our written permission.
- Upload or transmit viruses, malware, or any other harmful code.
- Infringe upon the intellectual property rights of others.
- Circumvent the Platform to conduct deals with other users outside of our system to avoid fees.
8. Payments and Fees
- Payment terms for specific services will be presented at the time of purchase.
- All fees are in Indian Rupees (INR) unless otherwise stated.
- Payments are processed through our payment gateway partner (PayU). By making a payment, you agree to PayU's terms and conditions.
- All fees are non-refundable unless otherwise stated or required by law.
- We reserve the right to change our fee structure with 30 days' notice.
9. Intellectual Property
The Platform, including its design, features, and content created by us, is owned by BuzzInsect and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.
You retain ownership of content you upload to the Platform. By uploading content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content solely for the purpose of operating the Platform.
10. Disclaimers
BuzzInsect acts solely as a marketplace connecting Creators and Brands. We are not a party to any agreements between Creators and Brands. We do not guarantee:
- That any Creator will meet a Brand's campaign requirements.
- The success or results of any influencer marketing campaign.
- That the Platform will be available at all times, error-free, or secure.
- The accuracy of any user-provided metrics or information.
The Platform is provided "as is" and "as available" without warranties of any kind.
11. Limitation of Liability
To the maximum extent permitted by law, BuzzInsect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
12. Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Platform will immediately cease. You may also delete your account at any time by contacting us.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
